These Terms & Conditions govern your use of SmartMathBoard and the SmartMathBoard service, available at smartmathboard.com (the "Service"). The Service is provided by NewYorkez LLC ("we", "us"). By using the Service you are contracting with NewYorkez LLC. You can reach us at contact@smartmathboard.com.

1. Acceptance of these terms

By creating an account, purchasing a subscription, or continuing to use the Service, you agree to these terms. If you do not agree, please stop using the Service. If you are using the Service on behalf of a school or organization, you confirm you have authority to bind it; if you are using it as an individual, you confirm you are of legal age in your jurisdiction or have permission from a parent or guardian.

2. What the Service provides

SmartMathBoard is a web application for generating and presenting mathematics questions, figures, graphs, and worked solutions. SmartMathBoard provides a paid, self-paced math practice set that also lets subscribers request live online instructor sessions. Live online tutoring sessions are 15 minutes long and are held by appointment; the number of sessions available each week depends on your subscription plan. Live sessions cover only questions originating from SmartMathBoard.com; questions from other sources are not eligible for instructor help. Access to SmartMathBoard paid features requires an active paid subscription.

One free live session of 15 minutes (per month) is included. Additional sessions are available at a cost of $30. Sessions take place on Google Meet upon appointment.

3. Accounts

• You must provide accurate information and keep it up to date.
• You are responsible for keeping your Google or Apple sign-in credentials confidential and for all activity under your account.

4. Acceptable use

You must not misuse the Service. In particular, you must not:

• use the Service for any unlawful purpose;
• engage in fraud, spam, or deceptive activity;
• infringe anyone's intellectual property or other rights;
• interfere with the security or integrity of the Service, including introducing malware, probing or scanning our systems, bypassing access controls, or scraping content;
• resell, redistribute, reverse engineer, or circumvent technical limits of the Service, or share paid access with people who have not purchased it.

5. Licence and intellectual property

We grant you a limited, non-exclusive, non-transferable right to use the Service within the plan you have selected, for your own teaching or study. We retain ownership of the Service and all intellectual property in it, including the software, question generators, figures, documentation, and branding. Material you create with the Service and use in your own classroom or study remains yours to use for that purpose.

6. Service level

We work to keep the Service available and accurate, but we do not guarantee uninterrupted or error-free performance. Generated questions, figures, and solutions are provided as teaching and study aids; you should review them before relying on them. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

7. Payment and subscription terms

SmartMathBoard is sold as a monthly subscription that automatically renews until cancelled. Payment, billing, currency, taxes, renewals, and cancellation are processed securely by Stripe. Please see our Refund Policy.

Charges appear on your statement from our payment provider. For any billing question, contact us at contact@smartmathboard.com and we will help.

Payments are non-refundable, including renewal charges and unused portions of a paid period, except where a refund is required by applicable law. You can cancel at any time using the Cancel subscription button on our Refund Policy page. Cancellation stops future renewals; access continues until the end of the current paid period.

8. Suspension and termination

We may suspend or terminate your access if you materially breach these terms, fail to pay, create a security or fraud risk, or repeatedly or seriously violate our acceptable use rules. You may cancel your subscription at any time; access continues until the end of the paid period. On termination, you may export or copy your own work during a reasonable window, after which your data may be deleted.

9. Liability

To the fullest extent permitted by law, our aggregate liability arising out of or relating to the Service is limited to the fees you paid in the twelve months before the claim. We exclude liability for indirect, consequential, or special damages, including loss of profits, data, or goodwill. Nothing in these terms limits liability for fraud, death, or personal injury caused by negligence where such limitation is not permitted.

10. Indemnity

You agree to indemnify us against claims arising from content you submit, your unlawful use of the Service, or your breach of these terms.

11. General

• These terms are governed by the laws of the State of New York, USA, and disputes are subject to the courts located there.
• You may not assign these terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
• Neither party is liable for delays caused by events beyond its reasonable control.
• We may update these terms; material changes will be posted on this page with a new "last updated" date.
